The florida eviction process is quite complicated and the landlord must be aware of all the rules and regulations and the deadlines as well. However, for the purpose of eviction, one must have the orders of the law court.
Here are certain steps of florida eviction process. The landlord has to undergo a whole lot of court procedures for this purpose. Moreover, delay should not be encouraged under any circumstances and the landlord should start the eviction process soon, if the rent remains unpaid.
1. The first step of the eviction process should be a three day notice. It should state that the rent has to be paid within a stipulated time period of three days or the property has to be vacated after three days. The notice should be issued and signed by the landlord.
2. The next step should be sending a five day notice or a residential eviction summon, which states that the tenant has five business days to report to the court for stating their reasons for not paying the rent.
3. A complain form for the removal of tenant must be handed over to the required person at the same time.
4. After these steps, if the tenant still has not answered to the court then a default package has to be sent after ten days. This includes non-military affidavit, writ of possession and others.
5. Soon after receiving the writ of possession, the judge signs it and it is then handed over to the sheriff.
6. The final step is then carried out by the sheriff who sends a notice to the tenants, asking them to evict within a stipulated time (usually 72 hours).
The eviction process thus, will be quite lucid to understand with the above steps.
