Under Arizona DUI Law What is Admin Per SE!
Under Arizona law, if an officer charges you with DUI it will set off two events. First, you will be faced with defending against the criminal charge of DUI and second, they typically will hand you or mail you an “Admin Per SE” form. An Admin Per SE form literally means “Administration in itself.”
The Admin Per SE form became effective in Arizona on January 1, 1988. The form was designed to separate the administrative actions imposed by the Arizona Motor Vehicle Division (“MVD”) from the potential criminal penalties that you would be facing through the Arizona courts. This is very important to note – once you have been handed or mailed an Admin Per SE form, if you do not request a hearing within 15 calendar days with MVD to contest the allegations contained in the Admin Per SE form, your Arizona driver’s license may be suspended for a period of 90 days or greater, depending upon your charges. This may occur even if you are later found not guilty of the DUI charges. It is because of these DUI intricacies that you should always consult with an attorney to ensure that you do not miss any important deadlines. A Chandler DUI Attorney or Scottsdale DUI attorney such as the lawyers at our firm would gladly provide free telephone consultations should you have questions about the Admin Per SE form and the general procedure of DUI cases in Arizona.
Another important point to note is that under Arizona law your driver’s license may be ordered suspended either from the courts or through the MVD. If you did not request a hearing and your license is ordered suspended through the Arizona MVD and this event occurs prior to any court DUI related criminal conviction you will not have to show proof of financial responsibility (SR22) with MVD. If MVD did not suspend your license, but the courts ordered it suspended, then this means that MVD will require proof that you have the requisite insurance to drive in Arizona for the next 3 years. Typically, your insurance companies charges a premium for SR22 insurance and now you will be feeling a monthly hike in your bills that will continue over the next 3 years.
In the event your case appears that it may end in a DUI conviction through the courts, you have the ability to stipulate to an MVD suspension to ensure that it is suspended prior to a DUI conviction through the courts. If this occurs you will not need an SR22 for the next 3 years.
